Both parties are represented by independent counsel and the lawyers agree to withdraw if the parties cannot collaboratively reach resolution and the case must go to trial.

  • Child custody and visitation — The legal concept of custody is divided into legal custody, including the right to make health and education decisions for the child, and physical custody, including the right to make day-to-day decisions about the child. Both legal and physical custody may be awarded jointly to both parents or solely to one parent. Even if sole physical custody is awarded, the other parent may seek visitation time with the child.
