Sacramento Removal Proceedings Lawyer

As in many areas of immigration law, there are many steps in the process of removal. A great deal of our practice in this area involves options for relief, if you are found to be removable. If one "door" is closed, another may be open.

Acts such as these may render a person removable:

  • Violation of the Immigration and Nationality Act or any other U.S. law
  • Violation of nonimmigrant status or a condition of entry into the U.S.
  • Aiding any other alien to enter the U.S. illegally
  • Engaging in marriage fraud to gain admission to the U.S.
  • Being convicted of certain crimes
  • Failing to register or falsifying documents related to entry into the U.S.
  • Engaging in an activity that endangers public safety or creates a national security risk

Removal Proceedings

If you have received a Notice to Appear (NTA), this is the beginning of the process. The Immigration Court will have received a copy also. The NTA should state the reasons for the deportation/removal. A hearing will be scheduled. The earlier you retain an attorney, the more informed and prepared you will be. You will be asked to verify the contents of the NTA. If the judge finds that the information in the NTA is correct then you can be deported.

Relief

There are several ways to either apply to stay in the country, or voluntarily leave and avoid deportation that way. The law provides for special categories of relief, for example, for individuals who have suffered discrimination or torture, or cancellation of removal for legal permanent residents and non-legal permanent residents.

If you don't obtain a favorable decision from the immigration judge, you may be able to appeal to the Board of Immigration Appeals (BIA), or ultimately to the U.S. Court of Appeals and the Supreme Court.
