Immigrant Crime Victims Eligible for Special Visas
Jennifer L. Manning, August 9, 2010
As part of an initiative to reduce crime, USCIS announced that certain non-permanent US residents may qualify for a U visa-if they have suffered substantial physical or mental abuse as a crime victim and can help law enforcement investigate. Qualifying residents may include foreign students, visitors, workers on temporary visas, and undocumented workers.
The applicant can get a "certification of helpfulness" letter from a local law enforcement agency verifying he or she is aiding in a criminal investigation or prosecution. The applicant then includes this certification letter with an I-918 form and other requirements specified in the form's instructions.
Agencies eligible to provide certification letters include federal, state, and local law enforcement, prosecutors, and other agencies charged with investigating or prosecuting crimes.
