Divorce Process: An Overview

The divorce process includes identifying and dividing community assets and debts, making determinations about child custody and visitation and addressing any requests for spousal or child support. It begins when a spouse files a Petition for Dissolution of Marriage. Once a spouse is served with the petition, he or she has 30 days to respond. The case may conclude with the parties signing a Marital Settlement Agreement or the court deciding how to award property, debts, custody and support.
